Visual Studio Code is not proprietary, it is open source.

Technically you are right. However it is not clear whether you are allowed to
link to the MS extension gallery in the OSS version and the offical version is
not provided under an open source license. It also has a quite painful and
esoteric build process that is difficult to adapt to different packaging
guidelines.
