All fair enough and I am not an antitrust lawyer, so both of us are

equally in the dark about how likely a possibility it is. It is
definitely new territory, but then you never know what will provoke the FTC
(or who is having the behind-the-scenes conversations with them).
What I think is intriguing about it is that it is almost an inchoate threat
-- it's not likely now, but as the copyleft-next license becomes more
popular the competitive threat becomes more real. So you've planted the
seed and there's not an "oops, never mind" opportunity later in time.
It's
a time bomb.
