You could use the new disk for a backup, then shrink the oversized
partition.

Yes you are right. I could shrink the filesystem.
My problem starts, because gparted complains a warning, that it is
possible not able to boot.
therefore i cancel the operation and read a bit deeper.

All filesystems need backups. It seems wasteful to do an extra
install.
